These Terms of Service (the "Terms") form a binding agreement between you and Tren ("Tren," "we," "us") governing your access to and use of (i) our desktop client software, including all updates, components, and related materials (the "Client"), (ii) the account portal located at portal.tren.gg (the "Portal"), and (iii) any related services, communications, or features we provide (together with the Client and the Portal, the "Service").

By creating an account, downloading or installing the Client, paying for a subscription, or otherwise using the Service, you agree to these Terms. If you do not agree, do not use the Service.

Please read Section 16 carefully. It contains a mandatory arbitration agreement and class action waiver that affect how disputes between you and Tren are resolved.

01 / sectionEligibility

Eligibility.

You may use the Service only if you are at least 18 years old and able to form a binding contract under applicable law. By using the Service, you represent and warrant that you meet these requirements and that the information you provide to us is accurate and current. The Service is not directed at children, and we do not knowingly accept users under 18.

02 / sectionAccounts

Accounts.

To use the Service you must register for an account through the Portal. You are responsible for maintaining the confidentiality of your credentials and for all activity that occurs under your account. You must notify us immediately at Support if you suspect any unauthorized access.

Each account is for a single individual. You may not share, transfer, lend, lease, or sell access to your account or your credentials. The seats included with your subscription are for use across your own personal computers only and may not be allocated to any other person.

03 / sectionLicense Grant

License Grant.

Subject to your compliance with these Terms and timely payment of all applicable fees, Tren grants you a limited, personal, non-exclusive, non-transferable, non-sublicensable, revocable license to download, install, and use the Client on the number of seats associated with your subscription tier, and to access the Portal in connection with your account. This license terminates automatically if your subscription lapses, if your account is terminated, or if you breach these Terms.

04 / sectionSeats and Devices

Seats and Devices.

Your subscription tier determines the number of seats (separate computers) on which you may run the Client concurrently. We enforce seat counts by reference to hardware-derived identifiers as described in our Privacy Policy.

If you wish to release a seat in order to authorize a different computer, the release takes 24 hours to process. This delay is a fraud-prevention measure intended to deter account sharing and is not waivable.

05 / sectionAcceptable Use; Server and Client Compliance

Acceptable Use; Server and Client Compliance.

You are solely responsible for ensuring that your use of the Client complies with the terms, rules, and policies of any Minecraft client, server, network, or platform on which you choose to run it. We do not endorse, encourage, or facilitate the violation of any third-party terms, and we are not responsible for any consequences arising from your use of the Client on systems where its use is prohibited, including account restrictions, suspensions, or other enforcement actions taken by any third party.

You must not:

  • ashare, sublicense, rent, lease, sell, or otherwise transfer access to the Service or your account, except where you have received express written permission from Tren to do so;
  • battempt to reverse engineer, decompile, disassemble, or derive the source code of the Client, except to the extent expressly permitted by applicable law that cannot be contractually waived;
  • ccircumvent, disable, or interfere with seat enforcement, license validation, telemetry, or any other security or anti-piracy feature of the Service;
  • dredistribute, mirror, upload, or otherwise make the Client or any portion of it available to any third party;
  • eremove, obscure, or alter any copyright, trademark, or other proprietary notice;
  • fuse the Service to develop, train, or improve any competing product;
  • guse the Service in violation of any applicable law or regulation;
  • huse the Service to harass, abuse, threaten, or harm any other person, including Tren personnel; or
  • iprovide false, misleading, or fraudulent information to Tren, including in connection with payment, identity, or eligibility.
06 / sectionRelationship to Minecraft and Mojang

Relationship to Minecraft and Mojang.

Tren is not affiliated with, endorsed by, sponsored by, or in any way officially connected with Mojang Studios, Microsoft Corporation, or any of their subsidiaries or affiliates. "Minecraft" and any related marks are the property of their respective owners and are used here only for descriptive identification.

07 / sectionSubscriptions and Billing

Subscriptions and Billing.

The Service is offered solely on a recurring subscription basis. By subscribing, you authorize Tren and its payment processor, Stripe, Inc. ("Stripe"), to charge your payment method on a recurring basis at the rate and interval applicable to your subscription tier.

Auto-renewal. Subscriptions automatically renew at the end of each billing period at the then-current price for your tier unless you cancel through the Portal before the renewal date. You may cancel at any time, and cancellation takes effect at the end of the then-current billing period.

Price and plan changes. We may change our pricing, plans, tiers, and seat allocations at any time. Changes will not affect your existing subscription during the remainder of its then-current billing period. We will notify you of any change that will affect the renewal of your subscription before it takes effect, and you may cancel before the change applies if you do not agree to it.

Taxes. All fees are exclusive of any applicable taxes, duties, or similar charges, which are your responsibility.

08 / sectionRefunds

Refunds.

All sales are final, subject to the following limited exception. We will consider a refund request on a case-by-case basis only if (i) the request is submitted to Support within 24 to 48 hours of the original charge, and (ii) the Service is materially non-functional through no fault of yours. We do not issue refunds for user error, change of mind, dissatisfaction with features, account termination for cause, third-party enforcement actions, or any other reason not described above.

09 / sectionChargebacks

Chargebacks.

Initiating a chargeback, payment dispute, or reversal with your payment provider in respect of any charge from Tren constitutes a material breach of these Terms. We will treat any such action as grounds for immediate termination of your account, forfeiture of all remaining subscription time, and addition to an internal denylist preventing future purchases. If you believe a charge is incorrect, contact Support before initiating any dispute with your payment provider.

10 / sectionSuspension and Termination

Suspension and Termination.

By you. You may cancel your subscription at any time through the Portal. You may delete your account at any time as described in our Privacy Policy. Cancellation stops future renewals; deletion is immediate and permanent.

By us. We may suspend or terminate your access to the Client, the Portal, or both, at any time, with or without prior notice, and in our sole discretion, for any reason, including:

  • aany breach or suspected breach of these Terms, regardless of materiality;
  • bany chargeback, payment dispute, failed payment, or fraudulent payment activity;
  • caccount sharing, license resale, or any attempt to circumvent seat enforcement;
  • dreverse engineering, leaking, mirroring, or unauthorized redistribution of the Client;
  • eprovision of false, misleading, or fraudulent information at any time;
  • fabusive, threatening, or harassing conduct toward Tren personnel or other users;
  • gtelemetry, audit data, or other information indicating any of the foregoing;
  • hconduct that we determine, in our sole discretion, exposes Tren, its users, or its providers to legal, financial, security, or reputational risk; or
  • iany other conduct we deem incompatible with the continued provision of the Service.

Effects of termination, expiry, or non-payment. Upon termination of your subscription, expiry of your subscription for non-payment, or termination of your account by us:

  • Access to the Client is disabled immediately.
  • If your account has not been terminated by us, you retain access to the Portal for the limited purpose of managing your subscription, updating your settings, and deleting your account, and your stored data is retained until you delete your account.
  • If your account has been terminated by us, access to the Portal may also be revoked, and you forfeit any unused subscription time and any potential refund eligibility under Section 8.
  • No refund of any kind will be issued in respect of any termination for cause.

Sections 5, 6, 8, 9, 10 (Effects), 11 through 19, and any other provisions that by their nature should survive, will survive termination of these Terms.

11 / sectionIntellectual Property

Intellectual Property.

The Service, including the Client and all software, designs, text, graphics, and other materials made available through it, is owned by Tren or its licensors and is protected by copyright, trademark, and other intellectual property laws. Except for the limited license granted in Section 3, no rights are granted to you, by implication, estoppel, or otherwise.

You retain ownership of any configurations or settings you create using the Client. You grant Tren a worldwide, royalty-free, non-exclusive license to host, store, transmit, and display such configurations solely as necessary to provide the Service to you.

12 / sectionDMCA and Copyright Complaints

DMCA and Copyright Complaints.

If you believe content on the Service or distributed in connection with it infringes your copyright, you may submit a notice under the Digital Millennium Copyright Act to Support. Your notice must include:

  • aa physical or electronic signature of the copyright owner or a person authorized to act on the owner's behalf;
  • bidentification of the copyrighted work claimed to be infringed;
  • cidentification of the material claimed to be infringing and information reasonably sufficient to locate it;
  • dyour contact information, including a mailing address, telephone number, and email address;
  • ea statement that you have a good-faith belief that the use is not authorized by the copyright owner, its agent, or the law; and
  • fa statement, made under penalty of perjury, that the information in the notice is accurate and that you are authorized to act on behalf of the copyright owner.

We will respond to valid notices in accordance with applicable law. Misrepresentations in a DMCA notice may subject you to liability under 17 U.S.C. § 512(f).

13 / sectionEnforcement and Telemetry

Enforcement and Telemetry.

We collect telemetry from the Client and the Portal as described in our Privacy Policy and use it, among other purposes, to detect and respond to account sharing, license leaking, payment fraud, automated abuse, and other violations of these Terms. We reserve the right to take action against any account based on this telemetry, including suspension, termination, and denial of future purchases, without any obligation to disclose the underlying signals.

Disclaimer of Warranties.

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE," WITHOUT WARRANTY OF ANY KIND. TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, TREN DISCLAIMS ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, AND ANY WARRANTIES ARISING OUT OF COURSE OF DEALING OR USAGE OF TRADE.

WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, SECURE, OR FREE OF VIRUSES OR OTHER HARMFUL COMPONENTS, OR THAT IT WILL BE COMPATIBLE WITH ANY PARTICULAR HARDWARE, SOFTWARE, GAME CLIENT, OR SERVER. WE MAKE NO REPRESENTATION OR WARRANTY REGARDING THE OUTCOME OF YOUR USE OF THE CLIENT ON ANY THIRD-PARTY PLATFORM, INCLUDING ANY MINECRAFT SERVER OR NETWORK.

Limitation of Liability.

TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT WILL TREN BE LIABLE TO YOU FOR ANY INDIRECT, INCIDENTAL, CONSEQUENTIAL, SPECIAL, EXEMPLARY, OR PUNITIVE DAMAGES, INCLUDING LOSS OF PROFITS, LOSS OF DATA, LOSS OF GOODWILL, OR LOSS OR SUSPENSION OF GAME ACCOUNTS, WHETHER ARISING IN CONTRACT, TORT, STATUTE, OR OTHERWISE, AND WHETHER OR NOT TREN HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

TREN'S TOTAL CUMULATIVE LIABILITY ARISING OUT OF OR RELATING TO THE SERVICE OR THESE TERMS WILL NOT EXCEED THE GREATER OF (A) THE TOTAL AMOUNT YOU PAID TO TREN IN THE TWELVE (12) MONTHS IMMEDIATELY PRECEDING THE EVENT GIVING RISE TO LIABILITY, OR (B) TEN US DOLLARS (USD $10).

16 / sectionArbitration Agreement and Class Action Waiver

Arbitration Agreement and Class Action Waiver.

PLEASE READ THIS SECTION CAREFULLY. IT AFFECTS YOUR LEGAL RIGHTS.

You and Tren agree that any dispute, claim, or controversy arising out of or relating to these Terms or the Service (a "Dispute") will be resolved by binding individual arbitration, except that either party may bring an action in small claims court for any claim that qualifies for small claims jurisdiction.

Informal resolution. Before initiating arbitration, you must send a written notice of the Dispute to Support describing the nature of the claim and the relief sought. The parties will attempt in good faith to resolve the Dispute informally for 30 days before either party may initiate arbitration.

Arbitration rules. Arbitration will be administered by the American Arbitration Association ("AAA") under its Consumer Arbitration Rules then in effect. Arbitration will be conducted by a single arbitrator in San Jose, California, or remotely by telephone or video conference if you prefer.

Class action waiver. YOU AND TREN AGREE THAT ANY DISPUTE WILL BE BROUGHT IN AN INDIVIDUAL CAPACITY ONLY AND NOT AS A PLAINTIFF OR CLASS MEMBER IN ANY CLASS, COLLECTIVE, OR REPRESENTATIVE ACTION. THE ARBITRATOR MAY NOT CONSOLIDATE CLAIMS FROM MULTIPLE USERS AND MAY NOT PRESIDE OVER ANY FORM OF REPRESENTATIVE PROCEEDING.

Opt-out. You may opt out of this arbitration agreement by sending written notice to Support within 30 days of first accepting these Terms. Your notice must include your account email and a clear statement that you wish to opt out of arbitration. Opting out will not affect any other provision of these Terms.

Severability of this section. If the class action waiver is held unenforceable in a particular case, that case will proceed in court, but the remainder of this Section 16 will remain in effect.

17 / sectionGoverning Law and Venue

Governing Law and Venue.

These Terms are governed by the laws of the State of California, without regard to its conflict of laws principles. Subject to Section 16, any action that is not subject to arbitration must be brought exclusively in the state or federal courts located in Santa Clara County, California, and you consent to the personal jurisdiction of those courts.

Indemnification.

You agree to indemnify, defend, and hold harmless Tren and its officers, employees, contractors, and agents from and against any and all claims, liabilities, damages, losses, and expenses, including reasonable attorneys' fees, arising out of or in any way connected with (a) your use of the Service; (b) your breach of these Terms; (c) your violation of any third-party right, including the terms of any Minecraft server, network, or platform; or (d) any content or configuration you submit through the Service.

19 / sectionExport Controls and Sanctions

Export Controls and Sanctions.

You may not use the Service if you are located in, or are a national or resident of, any country subject to a comprehensive US government embargo, or if you are listed on any US government list of restricted or denied parties. You represent that you do not fall into any such category and that you will comply with all applicable export control and sanctions laws in connection with your use of the Service.

20 / sectionChanges to These Terms

Changes to These Terms.

We may modify these Terms at any time by posting a revised version with a new effective date. If the change is material, we will notify active users by email or through the Portal before it takes effect. Your continued use of the Service after a change takes effect constitutes your acceptance of the revised Terms. If you do not agree to a change, your sole remedy is to cancel your subscription and stop using the Service.

21 / sectionGeneral

General.

Entire agreement. These Terms, together with our Privacy Policy, constitute the entire agreement between you and Tren with respect to the Service and supersede any prior agreements.

Severability. If any provision of these Terms is held to be unenforceable, the remaining provisions will remain in full force and effect.

No waiver. Our failure to enforce any provision is not a waiver of our right to do so later.

Assignment. You may not assign or transfer these Terms, by operation of law or otherwise, without our prior written consent. We may assign these Terms freely.

Notices. Notices to you may be provided by email to the address associated with your account or by posting to the Portal. Notices to us must be sent to Support.

Independent parties. No partnership, joint venture, employment, or agency relationship is created by these Terms.
